2. Guide of the Information Regulator

The Information Regulator has compiled a guide in terms of section 10 of the Act containing information to assist a person wishing to exercise a right under the Act. The guide is available from the Information Regulator (South Africa), Woodmead North Office Park, 54 Maxwell Drive, Woodmead, Johannesburg, 2191, or at inforegulator.org.za (opens in a new tab).

3. Records held

Phapano holds records in the following categories:

  • Directory listing records, comprising information submitted by professionals for publication.
  • Correspondence with professionals and members of the public.
  • Website technical and operational records held by our service providers.
  • Governance, financial and statutory records.

Records of published listings are available on this website without a formal request.

4. Records available in terms of other legislation

Certain records are available in terms of other legislation, including the Companies Act 71 of 2008, the Nonprofit Organisations Act 71 of 1997 and the Income Tax Act 58 of 1962.

5. How to request access

A request must be made on the prescribed form and sent to the Information Officer at the email address above. The request must provide sufficient particulars to identify the record and the requester, state the form of access required, and specify the right that the requester seeks to exercise or protect and why the record is required to exercise or protect that right.

6. Fees

A request fee and access fee may be payable in accordance with the prescribed tariff before a request is processed or a record released.

7. Grounds for refusal

Access to a record may be refused on the grounds set out in Chapter 4 of Part 3 of the Act, including the mandatory protection of the privacy of a third party, the commercial information of a third party, and records privileged from production in legal proceedings.

8. Remedies

A requester who is dissatisfied with a decision may lodge a complaint with the Information Regulator or apply to a court in accordance with the Act.
