These terms govern your access to and use of the Phapano Directory website. By accessing or using the website you agree to be bound by these terms. If you do not agree, do not use the website.

1. Nature of the service

Phapano Directory is an information and listing service. It provides information about psychology professionals registered in South Africa and general educational content about the psychology professions.

Phapano is not a healthcare provider. Nothing on this website constitutes psychological, medical, clinical, diagnostic or therapeutic advice, and no content on this website should be relied upon as a substitute for consultation with an appropriately registered professional.

Phapano is not an emergency service. If you are in immediate danger, contact the emergency services on 10111 or 112, or see our crisis and support page.

2. No professional relationship

Use of this website does not create any therapeutic, clinical, professional or fiduciary relationship between you and Phapano. Any relationship you enter into with a listed professional is solely between you and that professional. Phapano is not a party to it, does not supervise it and has no involvement in it.

3. No endorsement or recommendation

Inclusion in the directory is not an endorsement, recommendation, certification or warranty of any professional, or of the quality, safety or suitability of any service they provide. Phapano does not evaluate clinical competence and does not recommend one professional over another.

4. Listing information and verification

Listing information is supplied by professionals themselves. Where a listing displays a verification indicator, it means only that we compared the registration details supplied against publicly available records of the Health Professions Council of South Africa on the date indicated. It is not a statement about competence, conduct, insurance, availability or fitness to practise.

Registration status, practice details, fees and availability may change at any time and may become out of date between checks. You are responsible for confirming any information that is material to your decision directly with the professional, and you may verify any registration independently with the Health Professions Council of South Africa.

5. Your responsibilities

You are solely responsible for your choice of professional and for any decision you make in reliance on information obtained from this website. You agree to use the website lawfully, and not to scrape, harvest, republish or use listing data for marketing or any commercial purpose without our prior written consent.

6. Professionals

If you apply to be listed, you warrant that the information you supply is accurate, that you hold current registration in the category stated, and that you are entitled to practise. You agree to notify Phapano promptly of any change to your registration status, practice details, services, availability or contact details.

You remain solely responsible for your own professional conduct, ethical compliance, client management, records, consent processes, fees and service delivery. Phapano may amend, suspend or remove any listing at its discretion, including where information appears inaccurate or where registration cannot be confirmed.

7. Fees

Access to the directory is free for members of the public.

Professional membership is a paid, recurring subscription. Current rates and any introductory pricing are published on the professional membership page, together with answers on billing, renewal and cancellation. Membership is charged through PayFast and renews automatically, monthly or annually according to the option chosen, until it is cancelled.

No charge arises from submitting an application. Payment is requested only after a professional’s registration has been checked against the public HPCSA register. A listing becomes publicly visible only once that check is complete, membership is active, and Phapano has published it.

Cancellation stops future payments and does not shorten a period already paid for; a listing remains visible until the end of that period. Where a payment fails, membership is treated as in arrears for a short period before the listing becomes ineligible to remain public, so that a payment problem can be resolved without the listing being removed immediately. Requests to cancel or to remove a listing may be sent to info@phapano.com.

Phapano may change membership rates. Where a rate changes for an existing member, the change applies from their next renewal and not to a period already paid for.

8. Third party content and links

The website may contain information supplied by third parties and links to external websites. Phapano does not control and is not responsible for third party content, and the inclusion of a link does not imply endorsement.

9. Disclaimer of warranties

The website and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Phapano gives no warranties of any kind, whether express or implied, including as to accuracy, completeness, currency, fitness for a particular purpose or uninterrupted availability.

10. Limitation of liability

To the fullest extent permitted by law, Phapano, its directors, employees and agents shall not be liable for any direct, indirect, incidental, consequential, special or punitive loss or damage arising out of or in connection with your use of the website, your reliance on any information obtained from it, or any act or omission of any listed professional, including any loss of profits, loss of data, personal injury or emotional harm.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including under the Consumer Protection Act 68 of 2008.

11. Indemnity

You indemnify Phapano against any claim, loss, liability or expense arising from your breach of these terms or your unlawful or improper use of the website.

12. Intellectual property

All content on this website, other than listing information supplied by professionals, is owned by or licensed to Phapano and may not be reproduced without permission.

13. Privacy

Our privacy policy forms part of these terms.

14. Changes

Phapano may amend these terms at any time. The effective date above indicates when they were last revised. Continued use after a change constitutes acceptance.

15. Governing law

These terms are governed by the laws of the Republic of South Africa, and the parties submit to the jurisdiction of the South African courts.
